Applies to: the Android and iOS application “Fake Call (이놈아저씨)”

1. Purpose

These terms set out the conditions for using the application “Fake Call (이놈아저씨)” (the App) provided by Appl.GongBang (the Company), and the rights and obligations of the Company and of users.

2. Effect and amendment

1. These terms apply to everyone who installs or uses the App.
2. The Company may amend these terms where necessary, within the limits of applicable law.
3. Amendments and their effective date are posted on this page. Changes unfavourable to users are posted at least seven days before they take effect.
4. If you do not agree to an amendment you may stop using the App and uninstall it. Continuing to use the App after the effective date is taken as acceptance.

3. The service

1. The App is a play application that stages a phone call from a character.
2. Its main features are:
   • Pretend calls with the character assigned to the last digit dialled
   • A custom character built from a photo and voice recorded by the user
   • Call recording, playback, and a call history
   • Downloading new characters
3. The App requires no sign-up or login and creates no account.
4. The Company may improve or change the features of the service.

4. The App is not a real telephone

1. Calls in the App are staged play and use no telecommunications network. There is no person on the other end; prepared audio is played back.
2. No emergency contact of any kind can be made through this App. In an emergency, use the real phone function of your device or the relevant emergency services.
3. Whether and how to use the App for guiding or teaching a child is the decision and responsibility of the guardian. The Company does not warrant any particular educational effect.
4. Please stop using the App if a child becomes excessively frightened or anxious.

5. Coins

1. Coins are the unit consumed when starting a call in the App. One call uses one coin.
2. Coins are granted free of charge only, as follows:
   • An initial grant when the App is first installed
   • A daily top-up, once per day, on the day after the balance reaches zero
   • A top-up when the user chooses to watch a rewarded advertisement in full
3. Coins cannot be purchased, and the App contains no payment function.
4. Coins have no cash or property value. They cannot be exchanged for money, refunded, transferred, traded with others, or taken outside the App.
5. Coins are recorded only on your device. Changing devices or uninstalling the App therefore causes any remaining coins to be lost, and they cannot be restored. The Company neither stores nor can recover them.
6. The Company may change how coins are granted, and in what quantity, where operationally necessary.

6. Advertising

1. The App offers a single rewarded ad format as a way to top up coins. It plays only when the user chooses to watch it and never interrupts normal use.
2. Advertising is delivered through Google AdMob. Ad requests from the App carry a child-directed treatment signal and a general-audience content rating limit.
3. Ad content is determined by advertisers and the ad provider and is not individually reviewed by the Company. If you see something inappropriate, please tell us at the address in section 14 and we will report it to the ad provider and take what steps we can.
4. Advertising may be unavailable depending on network conditions or ad inventory. The daily top-up remains available in that case.

7. Content you create

1. Rights in the photos, voice recordings, character names and call recordings you create in the App (Your Content) belong to you.
2. Your Content is stored only on your device and is not transmitted to the Company. We can neither store nor read it, and accordingly we acquire no rights of any kind in it. See the Privacy Policy for details.
3. Because Your Content exists only on your device, the Company cannot restore it. Use the sharing feature to keep copies of anything you would not want to lose to device loss, a factory reset or uninstallation.
4. If you use another person's face, voice or name in Your Content, obtaining their consent and taking any other necessary steps is your responsibility.

8. User obligations

You must not:

1. Reverse-engineer, decompile, copy without authorisation, or modify the App, or attempt to do so
2. Place abnormal load on the App or its distribution servers, or collect data from or access them by automated means
3. Extract the characters, audio or artwork of the App without authorisation and distribute or commercially exploit them
4. Use the App to threaten, harass or deceive another person, or otherwise to cause harm
5. Act in any other way that violates applicable law

9. Intellectual property

1. Rights in the App and in the characters, artwork, audio, text, trade marks and software it contains belong to the Company or the respective rightsholders.
2. The Company grants you a non-transferable right to use the App for personal, non-commercial purposes.
3. Your Content under section 7 is not subject to this section.

10. Changes to and suspension of the service

1. The Company may change the service, or suspend it in whole or in part for technical or operational reasons.
2. Where the service is to be discontinued permanently, the Company will give advance notice so far as it is able.
3. Even if the service is suspended, content already saved on your device remains there.
4. If character downloads become unavailable, the App remains usable with the characters bundled with it.

11. Limitation of liability

1. The Company is not liable where it cannot provide the service for reasons beyond its reasonable control, such as natural disaster, network failure, or policy changes by an operating system or device manufacturer.
2. The Company is not liable for problems arising from your device environment or from causes attributable to you.
3. The Company gives no warranty as to information or results obtained through the App.
4. Nothing in this section excludes liability for the wilful misconduct or gross negligence of the Company, or any other liability that applicable law does not permit to be limited.

12. Children and guardians

1. The App is designed on the assumption that children will use it.
2. Where a child uses the App, a guardian should review these terms and the Privacy Policy and decide whether and how it is used.
3. Features requiring device permissions, such as choosing a photo or recording audio, are best used with a guardian present.

13. Governing law and disputes

1. These terms and use of the service are governed by the laws of the Republic of Korea.
2. In the event of a dispute, the Company and the user will endeavour to resolve it in good faith through discussion.
3. Where discussion does not resolve the matter, proceedings may be brought before the court having jurisdiction under the Korean Civil Procedure Act.
4. The Korean language version of these terms is authoritative. Versions in other languages are translations provided for convenience; in the event of any discrepancy, the Korean version governs.
